Therms of Service (ToS - EN)
This contract applies between the artist, hereinafter referred to as the seller, and the person or institution that acquires an artwork from the seller, hereinafter referred to as the customer.
By ordering a product from the seller, the customer agrees to the following conditions:
PAYMENT
The customer agrees to pay the amount due in advance if the order value is less than or equal to €50.
For orders over €50, the customer agrees to pay half of the invoice amount in advance. The second half is to be paid upon approval of the initial sketch.
Any other payment plan must be mutually agreed upon before work on the product begins.
The customer acknowledges that work will only begin once payment according to the agreed plan has been received by the seller.
Certain types of work do not allow split payments. In such cases, the customer will be informed and asked to agree to an alternative payment plan before work begins.
DELIVERY OF THE PRODUCT
The customer agrees that the finished product will be delivered digitally to the email address provided by the customer or via Telegram once the final payment has been received by the seller.
Any other type of delivery—digital or physical—must be agreed upon before work begins. The customer bears all additional costs arising from alternative delivery methods, such as shipping costs, material costs, or fees for digital services. (This applies to traditional commissions, which are currently not offered.)
It is the sole responsibility of the customer to propose a delivery method that works for both parties. The seller cannot be held liable for loss of access, lost files, spam filters, or other technical issues beyond their control.
8b. After delivery of the product, responsibility for secure storage lies with the customer. Loss due to negligence will not be reimbursed. The seller cannot guarantee that an original copy of the file will still be available in case of loss.
REVISIONS
The customer is entitled to any number of revisions during the sketch phase.
However, major changes that significantly exceed the original scope of work may be subject to an additional fee.
Completion is defined as the period between finishing the drawing work and sending the final file to the customer.
During this phase, smaller adjustments can still be suggested and implemented.
If a desired change significantly exceeds the original scope of work, I reserve the right to decline it or charge an appropriate additional fee.
CURRENCY CONVERSION
The customer agrees to pay the amount stated in the invoice in euros [€].
The customer bears all costs associated with currency conversion, bank fees, payment provider fees, or other transfer costs.
A payment is considered fully completed only when the entire invoice amount in euros [€] has been credited to the seller’s account.
REFUND POLICY
The customer has the right to request a full refund if no progress has been made for two consecutive months or if the product has not been completed within four months.
Different deadlines apply for larger projects if separately agreed upon.
This regulation does not apply to interruptions caused by unforeseeable circumstances such as illness, accident, or other credibly documented reasons.
The customer agrees to active and reliable communication.
If there is no response for an extended period, I will pause work on the commission until I receive a reply.
This may accordingly delay the processing time.
PERSONAL AND COMMERCIAL USE
The product created by the seller is intended for private use only.
Any commercial use, resale, reproduction, or publication for other purposes requires the prior consent of the seller and a separate agreement on conditions and compensation.
For commercial use, a license will be issued according to the usage terms.
The customer has no right to use the created product in blockchain-based technologies—including but not limited to NFTs, cryptocurrencies, or any use related to tokenization or trading systems.
Furthermore, the customer has no right to use the product for AI datasets, AI training purposes, AI tools, or similar current or future technologies.
CANCELLATION
The seller reserves the right to refuse or cancel any order without giving reasons, provided a full refund is issued.
Disrespectful behavior toward the seller will not be tolerated and may result in cancellation of the order.
In this case, the customer will receive a full or partial refund, depending on the work progress already completed.
The seller reserves the right to refuse future commissions from the customer.
INVOICE ISSUANCE & DATA PROTECTION
I operate commercially and issue a proper invoice for every commission.
For issuing the invoice, the customer’s full name and address are required.
All personal data collected in the course of order processing will be treated confidentially and not shared with third parties.
Both the customer and I agree to treat all exchanged data, files, and information confidentially.
Disclosure occurs only if required by law or necessary for tax purposes (e.g., to the tax office).
I am a small business owner according to § 19 UStG. No sales tax is shown on the invoices.
ADVERTISING AND PUBLICATION
I reserve the right to use completed commission works for my own advertising purposes,
e.g., for presentation on my website, in portfolios, or on social networks such as my art channel on Telegram.
The customer may also publish the created work. Mentioning my name or the above-mentioned social media accounts is not mandatory but greatly appreciated.
Some works created by me may include a visible or invisible watermark or signature.
This may not be removed or altered without my explicit permission.
In the event of violations of these terms of use or proven unauthorized use of the created work,
I reserve the right to revoke the granted usage rights with immediate effect.
